These Terms of Service (“Terms,” “Agreement”) govern your use of our website, services and products available through the HSA and FSA Shop (the “Site”) operated by Think Discount, LLC (“Company,” “we,” “us,” or “our”). By accessing or using our Site, you (“you,” “your,” “customer,” “user”) agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use our Site.

Conditions of Use

When you visit our Site and purchase products, you engage in our “Service” and agree to these Terms. These Terms apply to all users of the Site, including browsers, vendors, customers, merchants and/or contributors of content. We may update these Terms from time to time; it is your responsibility to check this page periodically for changes. Continued use of the Site following posting of any changes constitutes acceptance of those changes.

Eligibility and HSA/FSA Products

We sell items that may qualify as HSA (Health Savings Account) or FSA (Flexible Spending Account)‑eligible. However:

  • Informational purposes only. Item eligibility varies by plan and may change under IRS rules. You should consult official sources such as IRS Publication 502 and Publication 969 to verify eligibility, and confirm with your HSA/FSA administrator before purchasing.
  • No medical advice. We are not healthcare providers and do not provide medical, legal or tax advice. Some products may require a Letter of Medical Necessity (LMN) from a healthcare provider to qualify. It is your responsibility to obtain any required documentation and ensure compliance with your plan’s rules.
  • Plan compliance. You agree that you will not use your HSA/FSA funds to purchase products that are not eligible under your plan. We are not liable for any adverse tax consequences that result from ineligible purchases.

Orders, Pricing and Payment

Order Acceptance

We reserve the right to refuse or limit any order you place with us, including quantities purchased per person or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email address or billing/shipping address provided at the time the order was made.

Pricing and Availability

Prices for our products are subject to change without notice. We attempt to display accurate pricing information, but errors may occur. We reserve the right to correct any errors or omissions and to cancel any order arising from such errors.

Payment

All purchases are processed via third‑party payment processors (e.g., Shopify Payments) which adhere to PCI‑DSS standards for secure payment processing. When you submit payment information, you authorize us and our service providers to charge the total purchase amount to your payment method. We do not store full payment card numbers on our servers.

Shipping and Delivery

  • Shipping Timeframes. We will ship your order within the advertised timeframe. If no shipping time is specified, we will ship within 30 days as required by the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule. If we cannot ship within that timeframe, we will contact you to offer a revised delivery date or refund.
  • Risk of Loss. Title and risk of loss pass to you upon our delivery of the product to the carrier. You are responsible for filing any claims with carriers for damaged or lost shipments.
  • Shipping Restrictions. We ship only to addresses within the United States unless otherwise noted. We are not responsible for delays due to customs clearance, shipping carrier delays, or events outside our control.

Returns and Refunds

We want you to be satisfied with your purchase. Please review our Return and Refund Policy (linked in our site footer) for details on time frames, eligible items, and procedures for returning products. Some items, particularly personal‑care products or items classified as medical devices, may be non‑returnable due to health and safety regulations. Refunds will be issued to the original form of payment (e.g., HSA/FSA card or credit card) unless otherwise stated.

Accuracy of Information

We strive to provide accurate descriptions of products and prices; however, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current or error‑free. If a product offered by us is not as described, your sole remedy is to return it in unused condition in accordance with our return policy.

Prohibited Uses

You agree not to use the Site or our products for any unlawful or unauthorized purpose, including but not limited to:

  • Violating any applicable local, state, federal or international laws or regulations.

  • Purchasing non‑eligible items using HSA/FSA funds.

  • Infringing or violating our intellectual property or the intellectual property rights of others.

  • Transmitting viruses or malicious code that will or may be used in any way that will affect the functionality or operation of the Service.

  • Collecting or tracking the personal information of others.

  • Engaging in spamming, phishing, or other abusive practices.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

Intellectual Property

All content on our Site—including text, graphics, logos, images and software—is the property of Think Discount, LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, transmit or otherwise exploit any content without our prior written permission. Our trademarks and trade dress may not be used without our express written consent.

Our Site may contain links to third‑party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of these third‑party sites, and we do not warrant and will not have any liability for any third‑party materials or websites. Promotions and Discount Codes

We may offer promotional codes or sales from time to time. We reserve the right to modify or discontinue promotions at any time without notice, and to limit quantities purchased per person or per order. Promotional codes cannot be used retroactively on previous purchases and may not be combined with other offers.

Disclaimer and Limitation of Liability

  • Disclaimer of Warranties. The Site and all products and services delivered to you through the Site are provided “as is” and “as available” without any representation, warranties or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non‑infringement.

Indemnification

You agree to indemnify, defend and hold harmless Think Discount, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys’ fees, made by any third‑party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third‑party.

Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. You agree that any dispute or claim arising out of or relating to the Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in Washington.

Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

We may terminate or suspend your access to the Site without prior notice or liability for any reason, including if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty and liability limitations, and indemnity obligations.

Changes to the Terms

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our Site following the posting of any changes constitutes acceptance of those changes.
